What are my company's obligations to employees who are called up to the military reserves or National Guard?
The Uniformed Services Employment and Re-employment Rights Act (USERRA) provides employees who serve on active duty with the armed forces, reserves, or National Guard with special job protections. If the employees give notice before they leave and report back in a timely manner, USERRA requires reinstatement to the job that the employees would have attained had they never been absent for military service. Limited health care coverage must also be maintained. USERRA applies to employers of all sizes.
