Is an agreement entered into by clicking an "I Agree" button (i.e., a click wrap agreement) legally enforceable?
This question has not yet been authoritatively answered by the courts. Some types of agreements, for example, are required by law to be in writing (e.g., agreements to sell real property). However, the National Conference of Commissions on Uniform State Laws has recently enacted the Uniform Electronic Transactions Act. This Act validates electronic signatures in many circumstances and has already been adopted by California.
