How do I know my employee Confidentiality and Non-Competition Agreement is enforceable?
A properly drafted agreement can restrict a former employee's ability to raid the customers and employees of a company. The agreement must be carefully tailored to only protect the employer's legitimate business interests. The agreements should not be so broad as to restrict entirely a former employee's ability to earn a living. Further, each state has laws regarding the enforceability of such agreements. Certain states like California discourage these agreements to the point of outlawing them.
