Question What must I consider before terminating an employee?

Question Many employers, particularly employers in at will jurisdictions, think an employee without a written employment contract can be terminated without risk of consequences. This is a dangerous misconception. Is the employee over 40, female or in another protected class? Is there a company handbook with procedures - and were they followed? Is the employee about to vest in any benefits, commissions, or stock options? What was said to the employee at hiring, particularly if the employee was hired away from another company? Knowing how to deal with these issues before termination will save time, money and stomach lining.
